In what cases will the sale of dietary supplements be prohibited?

The Government of the Russian Federation published Resolution No. 1944 containing lists of cases in which the mandatory labeling system may prohibit the sale of dietary supplements, disinfectants and water. The resolution will come into force on December 21, 2023.

A ban on the sale of a particular product can be introduced on the basis of information received from the state information system for monitoring the circulation of goods subject to mandatory marking with identification means in real time.

The sale of dietary supplements may be prohibited for the following reasons:

• information about such a product is not available in the labeling system;
• at the time of sale, such goods are marked as withdrawn from circulation;
• the sale of goods is suspended or prohibited by the supervisory authority;
• information about the introduction of goods into circulation is not included in the labeling system;
• the product has expired;
• the product verification code does not correspond to the characteristics of the identification device.

The bans are planned to be introduced from November 1, 2024. At the same time, the period and method for introducing a ban when receiving information on monitoring the circulation of goods “offline” has not been established.

The rules for labeling certain medical products, dietary supplements and skin antiseptics on the territory of the Russian Federation came into force on October 1.

According to the requirements for mandatory labeling, participants in the circulation of dietary supplements, from September 1, 2023, must submit an application to the state information system for monitoring the circulation of goods for their registration 7 calendar days before the start of the introduction/withdrawal of such products from circulation.

Moreover, if, as of October 1, 2023, there are unsold dietary supplements on the territory of the Russian Federation, produced on the territory of the Russian Federation or imported into the territory of the Russian Federation on September 30, 2023 (inclusive), the Company has the right to sell such dietary supplements without labeling with identification means until their completion. expiration date.
