
Criminal law – wholesaling unregistered medical products
An individual entrepreneur was punished under criminal law in the Samara Region for wholesaling unregistered medical products.In the end of 2015, the officers of the Chief Administration of Internal Affairs in the Samara region detected the following medical products in circulation in the region: “Products for wrinkle filling Dermal Filler Platinum Bronze” produced by Renne BioMed Sarl, France, “Products for wrinkle filling Dermal Filler PlatinumSilver”, and “Products for wrinkle filling Dermal Filler Platinum Gold” produced by Dr.Korman Laboratories LTD, Israel; all the medical products were of doubtful quality.
The Central Office and the Local Agency of the Federal Service for Surveillance in Healthcare of Samara Region Control ran a series of monitoring arrangements to determine the quality of the medical products. After all necessary expert examinations, the officers of the Federal Service for Surveillance in Healthcare concluded that the medical products in question had not been officially registered and may not be distributed in the Russian Federation.
Based on the examination results, the Samara Region Investigation Committee initiated a criminal proceeding against the individual entrepreneur under Part 1 of Article 238.1 of the Criminal Code of the Russian Federation, “Distribution of counterfeit, poor-quality, or unregistered drugs and medical products and distribution of counterfeit dietary supplements”.
Having reviewed the case materials, the Oktyabrsky district court of the city of Samara found the individual entrepreneur guilty of committing a crime under Part 1 of Article 238.1 of the Criminal Code of the Russian Federation and imposed a penalty on him, according to the penal part of that Article, in the form of three-year suspended prison sentence. The court decision has come into effect.
